These general terms and conditions apply to all bookings made through the CapCorn Hotelclient (reservation system). This reservation system is provided free of charge by the system operator and the Obertauern Tourism Association to the individual accommodation providers.

The bookings made bindingly through this system exclusively establish a contractual relationship between the guest and the accommodation provider. The system operator and the Obertauern Tourism Association exclude any liability for claims arising from the use of this system. The contractual relationship between guest and accommodation provider is generally subject to the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) in the version of 15.11.2006. The "binding booking" via the client legally constitutes a binding offer from the guest to the respective accommodation provider. Only upon the accommodation provider's confirmation does a binding accommodation contract arise for both parties.

The contractual relationship between the guest and the accommodation provider is exclusively subject to Austrian law. In addition, the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006) http://www.hotelverband.at/down/AGBH_061115.pdf are agreed upon. Furthermore, the General Terms and Conditions used by the respective accommodation providers apply as additional contractual basis.

Terms and Conditions for the Obertauern Year-Round Sweepstakes

1. Sweepstakes

The Obertauern Tourism Association is seeking the answer to the question as part of this sweepstakes: When does the 2025/26 ski season end in Obertauern? 

A winner will be drawn from all participants by a random generator. Participation in the sweepstakes and its execution are subject to the following conditions.

2. Organizer

The organizer of the sweepstakes is the Obertauern Tourism Association, Pionierstraße 1, 5562 Obertauern (hereinafter "Tourism Association").

3. Eligible Participants

Persons who have reached the age of 18 at the time of their participation are eligible.

The participant in the sweepstakes is the person who submits an answer via the website www.obertauern.com - Year-Round Sweepstakes landing page. Each participant may only enter the sweepstakes once.

4. Exclusion from Participation

Employees of the Tourism Association including their respective family and household members are excluded from participation.

The Tourism Association reserves the right to exclude participants from the competition if the submitted answers violate applicable law or these terms and conditions.

5. Participation Period

The participation period of the sweepstakes runs from

October 22, 2025, 00:00 hours to May 2, 2026, 23:59 hours

The winner selection will take place on May 5, 2026. The winner will be determined by a random generator from all participants who declared their participation within the sweepstakes period and are eligible to participate.

6. Winner

The winner will be notified by email to the participant who submitted their answer. The claim to the prize expires 48 hours after contact by email. The winner must respond in writing by then. Afterwards, the prize will be raffled to another participant by random selection.

7. Prize

The prize consists of 3x 3 overnight stays for 2 persons in a 4* hotel in Obertauern including breakfast & 2-day ski passes. A cash payment is not possible. 

8. Termination of the Sweepstakes

The Obertauern Tourism Association expressly reserves the right to cancel the sweepstakes without prior notice and without giving reasons. This applies in particular to any reasons that disrupt or prevent the orderly course of the sweepstakes or if a correct execution is not possible for technical reasons.

9. Data Protection

Providing personal data is necessary to participate in the sweepstakes.

The participant assures that the personal data provided, especially first and last name and email address, are truthful and correct.

The Obertauern Tourism Association points out that all personal data of the participant will neither be passed on to third parties nor made available for use without consent.

In case of a win, the winner agrees to the publication of their name.

This includes the announcement of the winner on the organizer's website and social media platforms. The participant can revoke their declared consent at any time. The revocation must be sent in writing to the email address info@obertauern.com.

10. Applicable Law

These terms and conditions as well as the sweepstakes itself are exclusively subject to the law of the Republic of Austria.

11. Legal Recourse

Legal recourse is excluded.

Terms and Conditions for the Winter Chillout Sweepstakes

The Obertauern Tourism Association is raffling off as part of a sweepstakes 2x 2-day ski passes for 2 persons each for the current season

Terms and Conditions for Obertauern Instagram Sweepstakes

The entity responsible for conducting the Instagram sweepstakes is the Obertauern Tourism Association (Pionierstraße 1, 5562 Obertauern, Austria). Participation is free of charge and is exclusively subject to these terms and conditions. By participating in the sweepstakes, the participant accepts these conditions, which apply to the active sweepstakes on Instagram.

All @obertauern Instagram fans who are at least 18 years old are eligible to participate. The responsible party is entitled at any time to request appropriate proof. In case of justified doubts about the fulfillment of a participation requirement, the responsible party is entitled to exclude the participant from the sweepstakes. Employees of the responsible party are excluded from participation.

Among all participants, the winners will be randomly selected and notified after the participation deadline. If the winner does not respond within 1 day, the prize will be transferred to another participant. Exchange or cash payment of the prize is not possible. Legal recourse is excluded.

The sweepstakes is in no way connected to Instagram and is not sponsored, supported, or organized by Instagram. Participants cannot assert any claims against Instagram arising in connection with participation in the sweepstakes.

The responsible party expressly reserves the right to terminate the sweepstakes without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the orderly conduct of the sweepstakes. Austrian law exclusively applies.

Participants' personal data will be used exclusively for the execution of the sweepstakes and then deleted. Participants have the right to object to the use of their personal data at any time by written notification.
